General Terms & Conditions
These General Terms and Conditions ("GTC") govern the legal relationship between WTRH, Switzerland ("Operator") and the users ("User") of the mobile application "Swiss Fuel Finder" ("App").
By downloading or using the App, the User accepts these GTC in their entirety. Any conflicting terms provided by the User are explicitly excluded.
2.1 Nature of Information
The App provides a platform for comparing fuel prices and locations based on community-sourced data, public sources, and independent technical aggregation of third-party data.
2.2 Accuracy and Third-Party Interruption
Information regarding prices, opening hours, and fuel availability is subject to rapid change. The Operator provides this data on an "as-is" basis. No guarantee is given for the accuracy, completeness, or real-time validity of the data.
2.3 Savings Estimates
Calculations of "Net Savings" are indicative estimates. They do not constitute a financial guarantee or a binding offer.
3.1 Mandatory Registration
Access to price updates and personalized features requires a login via a Google Account.
3.2 Duty of Good Faith (Art. 2 ZGB)
Users agree to provide price updates in good faith. The intentional entry of false data is a breach of contract and will result in a permanent ban.
3.3 User Pseudos
Usernames ("Pseudos") must not infringe on third-party trademarks or public order. The use of official brand names or "Admin" titles is prohibited.
4.1 Pricing and VAT
All prices for Premium features are indicated in Swiss Francs (CHF) and include the statutory Swiss VAT of 8.1% in accordance with the Swiss Price Disclosure Ordinance (PBV).
4.2 Payments
- App Store / Google Play: Subject to the respective platform's terms.
- TWINT (Payrexx AG): The User must provide their SFF Pseudo for manual activation. The Operator is not liable for delays caused by incorrect Pseudo entry.
4.3 No Refunds
Pursuant to Swiss law, the right of withdrawal does not apply to digital content once performance has begun with the User's prior express consent. All sales are final, except in cases of proven technical non-performance by the Operator. Statutory rights of withdrawal or refund under Swiss consumer law remain unaffected in cases of service non-performance.
5.1 General Limit
The Operator is liable only for damages caused by unlawful intent or gross negligence. Liability for slight or medium negligence is excluded to the maximum extent permitted by Art. 100 para. 1 of the Swiss Code of Obligations.
5.2 Auxiliary Persons
Liability for auxiliary persons (Art. 101 CO), such as third-party hosting providers or data contributors, is entirely excluded.
5.3 Data Provenance and Indirect Damages
Liability for indirect damages, lost profits, data loss, or damages resulting from driving decisions/traffic violations is explicitly excluded.
6.1 Privacy Policy
The processing of personal data is governed by the SFF Privacy Policy.
6.2 Data Export Disclosure
The User acknowledges and consents that personal data (e.g., Google ID, payment logs) may be processed on servers located in the European Union (EU) or the United States (USA), provided that adequate safeguards (such as Standard Contractual Clauses) are in place to meet nFADP requirements.
The App's source code, design, and the "Swiss Fuel Finder" logo are the exclusive property of WTRH. Any unauthorized reproduction or reverse engineering is a violation of the Federal Act on Copyright and Related Rights (URG).
The Operator reserves the right to amend these GTC at any time. Users will be notified of significant changes via an in-app prompt. Continued use following notification constitutes acceptance of the revised terms.
9.1 Applicable Law
These GTC and all disputes arising therefrom are subject exclusively to Swiss Substantive Law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
9.2 Exclusive Jurisdiction
The exclusive place of jurisdiction for all legal proceedings is Lausanne (Vaud), Switzerland. For consumers, mandatory statutory places of jurisdiction remain reserved.
Les présentes Conditions Générales ("CG") régissent les relations juridiques entre WTRH, Suisse ("Opérateur") et les utilisateurs ("Utilisateur") de l'application mobile "Swiss Fuel Finder" ("Application").
En téléchargeant ou en utilisant l'Application, l'Utilisateur accepte les présentes CG dans leur intégralité. Toute condition conflictuelle fournie par l'Utilisateur est explicitement exclue.
2.1 Nature des informations
L'Application fournit une plateforme de comparaison des prix des carburants et des emplacements basée sur des données communautaires, des sources publiques et une agrégation technique indépendante de données tierces.
2.2 Exactitude et interruption par des tiers
Les informations concernant les prix, les heures d'ouverture et la disponibilité des carburants sont sujettes à des changements rapides. L'Opérateur fournit ces données "en l'état". Aucune garantie n'est donnée quant à l'exactitude, l'exhaustivité ou la validité en temps réel des données.
2.3 Estimations d'économies
Les calculs d'"Économies nettes" sont des estimations indicatives. Ils ne constituent pas une garantie financière ou une offre ferme.
3.1 Enregistrement obligatoire
L'accès aux mises à jour de prix et aux fonctionnalités personnalisées nécessite une connexion via un compte Google.
3.2 Devoir de bonne foi (Art. 2 CC)
Les utilisateurs acceptent de fournir des mises à jour de prix de bonne foi. La saisie intentionnelle de données fausses constitue une violation contractuelle et entraînera un bannissement permanent.
3.3 Pseudos des utilisateurs
Les noms d'utilisateur ("Pseudos") ne doivent pas enfreindre les marques de tiers ou l'ordre public. L'utilisation de noms de marques officiels ou de titres "Admin" est interdite.
4.1 Tarification et TVA
Tous les prix des fonctionnalités Premium sont indiqués en Francs Suisses (CHF) et incluent la TVA suisse légale de 8,1 % conformément à l'Ordonnance sur l'indication des prix (OIP).
4.2 Paiements
- App Store / Google Play : Soumis aux conditions des plateformes respectives.
- TWINT (Payrexx AG) : L'Utilisateur doit fournir son Pseudo SFF pour une activation manuelle. L'Opérateur n'est pas responsable des retards causés par une saisie de Pseudo incorrecte.
4.3 Aucun remboursement
Conformément au droit suisse, le droit de rétractation ne s'applique pas aux contenus numériques une fois que l'exécution a commencé avec le consentement exprès préalable de l'Utilisateur. Toutes les ventes sont finales, sauf en cas de non-performance technique prouvée par l'Opérateur. Les droits légaux de rétractation ou de remboursement en vertu du droit suisse de la consommation ne sont pas affectés en cas de non-exécution du service.
5.1 Limite générale
L'Opérateur n'est responsable que des dommages causés par un dol ou une négligence grave. La responsabilité pour négligence légère ou moyenne est exclue dans toute la mesure permise par l'Art. 100 al. 1 du Code des obligations suisse.
5.2 Auxiliaires
La responsabilité pour les auxiliaires (Art. 101 CO), tels que les fournisseurs d'hébergement tiers ou les contributeurs de données, est entièrement exclue.
5.3 Provenance des données et dommages indirects
La responsabilité pour les dommages indirects, la perte de profits, la perte de données ou les dommages résultant de décisions de conduite/infractions au code de la route est explicitement exclue.
6.1 Politique de confidentialité
Le traitement des données personnelles est régi par la Politique de confidentialité de SFF.
6.2 Divulgation de l'exportation de données
L'Utilisateur reconnaît et consent à ce que les données personnelles (par exemple, identifiant Google, journaux de paiement) puissent être traitées sur des serveurs situés dans l'Union Européenne (UE) ou aux États-Unis (USA), à condition que des garanties adéquates (telles que des clauses contractuelles types) soient en place pour répondre aux exigences de la LPD.
Le code source, le design et le logo "Swiss Fuel Finder" de l'Application sont la propriété exclusive de WTRH. Toute reproduction non autorisée ou ingénierie inverse constitue une violation de la Loi fédérale sur le droit d'auteur et les droits voisins (LDA).
L'Opérateur se réserve le droit de modifier les présentes CG à tout moment. Les Utilisateurs seront informés des changements importants via une notification dans l'Application. L'utilisation continue après notification constitue une acceptation des conditions révisées.
9.1 Droit applicable
Les présentes CG et tous les litiges en découlant sont exclusivement soumis au Droit matériel suisse, à l'exclusion de la Convention des Nations Unies sur les contrats de vente internationale de marchandises (CVIM).
9.2 Juridiction exclusive
Le for exclusif pour toute procédure judiciaire est Lausanne (Vaud), Suisse. Pour les consommateurs, les fors impératifs prévus par la loi restent réservés.
Diese Allgemeinen Geschäftsbedingungen ("AGB") regeln das Rechtsverhältnis zwischen WTRH, Schweiz ("Betreiber") und den Nutzern ("Nutzer") der mobilen Applikation "Swiss Fuel Finder" ("App").
Durch das Herunterladen oder die Nutzung der App akzeptiert der Nutzer diese AGB vollumfänglich. Etwaige entgegenstehende Bedingungen des Nutzers werden ausdrücklich ausgeschlossen.
2.1 Art der Informationen
Die App bietet eine Plattform zum Vergleich von Treibstoffpreisen und Standorten basierend auf Community-Daten, öffentlichen Quellen und unabhängiger technischer Aggregation von Drittdaten.
2.2 Genauigkeit und Unterbrechung durch Dritte
Informationen zu Preisen, Öffnungszeiten und Treibstoffverfügbarkeit unterliegen schnellen Änderungen. Der Betreiber stellt diese Daten ohne Gewähr ("wie besehen") zur Verfügung. Es wird keine Garantie für die Richtigkeit, Vollständigkeit oder Echtzeit-Gültigkeit der Daten übernommen.
2.3 Ersparnisberechnungen
Berechnungen von "Netto-Ersparnissen" sind indikative Schätzungen. Sie stellen keine finanzielle Garantie oder ein verbindliches Angebot dar.
3.1 Registrierungspflicht
Der Zugriff auf Preisaktualisierungen und personalisierte Funktionen erfordert eine Anmeldung über ein Google-Konto.
3.2 Pflicht zu Treu und Glauben (Art. 2 ZGB)
Nutzer verpflichten sich, Preisaktualisierungen in gutem Glauben bereitzustellen. Die vorsätzliche Eingabe falscher Daten stellt einen Vertragsbruch dar und führt zu einer dauerhaften Sperre.
3.3 Nutzer-Pseudos
Benutzernamen ("Pseudos") dürfen keine Markenrechte Dritter oder die öffentliche Ordnung verletzen. Die Verwendung offizieller Markennamen oder "Admin"-Titel ist untersagt.
4.1 Preise und MwSt.
Alle Preise für Premium-Funktionen sind in Schweizer Franken (CHF) angegeben und enthalten die gesetzliche Schweizer Mehrwertsteuer (MwSt.) von 8,1 % gemäss der Schweizer Preisbekanntgabeverordnung (PBV).
4.2 Zahlungen
- App Store / Google Play: Unterliegt den Bedingungen der jeweiligen Plattform.
- TWINT (Payrexx AG): Der Nutzer muss sein SFF-Pseudo für die manuelle Aktivierung angeben. Der Betreiber haftet nicht für Verzögerungen durch fehlerhafte Pseudo-Eingabe.
4.3 Keine Rückerstattung
Nach Schweizer Recht besteht bei digitalen Inhalten kein Widerrufsrecht, sobald die Ausführung mit der ausdrücklichen Zustimmung des Nutzers begonnen hat. Alle Verkäufe sind endgültig, ausser bei nachgewiesener technischer Nichterfüllung durch den Betreiber. Gesetzliche Widerrufs- oder Rückerstattungsrechte nach Schweizer Konsumentenschutzrecht bleiben bei Nichterfüllung der Leistung unberührt.
5.1 Allgemeine Beschränkung
Der Betreiber haftet nur für Schäden, die durch rechtswidrige Absicht oder grobe Fahrlässigkeit verursacht wurden. Die Haftung für leichte oder mittlere Fahrlässigkeit wird im maximal zulässigen Umfang gemäss Art. 100 Abs. 1 des Schweizerischen Obligationenrechts ausgeschlossen.
5.2 Hilfspersonen
Die Haftung für Hilfspersonen (Art. 101 OR), wie Drittanbieter von Hosting oder Datenlieferanten, wird vollständig ausgeschlossen.
5.3 Datenherkunft und indirekte Schäden
Die Haftung für indirekte Schäden, entgangenen Gewinn, Datenverlust oder Schäden infolge von Fahrentscheidungen/Verkehrsverstössen wird explizit ausgeschlossen.
6.1 Datenschutzerklärung
Die Verarbeitung personenbezogener Daten unterliegt der SFF-Datenschutzerklärung.
6.2 Offenlegung des Datenexports
Der Nutzer nimmt zur Kenntnis und willigt ein, dass personenbezogene Daten (z. B. Google-ID, Zahlungsprotokolle) auf Servern in der Europäischen Union (EU) oder den Vereinigten Staaten (USA) verarbeitet werden können, sofern angemessene Schutzmassnahmen (wie Standardvertragsklauseln) vorhanden sind, um die Anforderungen des DSG zu erfüllen.
Der Quellcode, das Design und das "Swiss Fuel Finder"-Logo der App sind ausschliessliches Eigentum von WTRH. Jede unbefugte Vervielfältigung oder Reverse Engineering stellt einen Verstoss gegen das Bundesgesetz über das Urheberrecht und verwandte Schutzrechte (URG) dar.
Der Betreiber behält sich das Recht vor, diese AGB jederzeit zu ändern. Nutzer werden über wesentliche Änderungen per In-App-Hinweis informiert. Die Fortsetzung der Nutzung nach der Benachrichtigung gilt als Annahme der geänderten Bedingungen.
9.1 Anwendbares Recht
Diese AGB und alle daraus resultierenden Streitigkeiten unterliegen ausschliesslich materiellem Schweizer Recht, unter Ausschluss des UN-Kaufrechts (CISG).
9.2 Exklusiver Gerichtsstand
Ausschliesslicher Gerichtsstand für alle rechtlichen Verfahren ist Lausanne (Waadt), Schweiz. Für Konsumenten bleiben zwingende gesetzliche Gerichtsstände vorbehalten.
Le presenti Condizioni Generali ("CGC") regolano il rapporto giuridico tra WTRH, Svizzera ("Operatore") e gli utenti ("Utente") dell'applicazione mobile "Swiss Fuel Finder" ("App").
Scaricando o utilizzando l'App, l'Utente accetta le presenti CGC nella loro interezza. Qualsiasi condizione conflittuale fornita dall'Utente è esplicitamente esclusa.
2.1 Natura delle informazioni
L'App fornisce una piattaforma per il confronto dei prezzi del carburante e delle posizioni basata su dati forniti dalla community, fonti pubbliche e aggregazione tecnica indipendente di dati di terze parti.
2.2 Accuratezza e interruzione da parte di terzi
Le informazioni riguardanti i prezzi, gli orari di apertura e la disponibilità del carburante sono soggette a rapidi cambiamenti. L'Operatore fornisce questi dati "così come sono". Non viene fornita alcuna garanzia per l'accuratezza, la completezza o la validità in tempo reale dei dati.
2.3 Stime di risparmio
I calcoli dei "Risparmi netti" sono stime indicative. Non costituiscono una garanzia finanziaria o un'offerta vincolante.
3.1 Registrazione obbligatoria
L'accesso agli aggiornamenti dei prezzi e alle funzioni personalizzate richiede il login tramite un Account Google.
3.2 Dovere di buona fede (Art. 2 CC)
Gli utenti accettano di fornire aggiornamenti sui prezzi in buona fede. L'inserimento intenzionale di dati falsi costituisce una violazione contrattuale e comporterà un ban permanente.
3.3 Pseudo degli utenti
I nomi utente ("Pseudo") non devono violare i marchi di terze parti o l'ordine pubblico. È vietato l'uso di nomi di marchi ufficiali o titoli "Admin".
4.1 Prezzi e IVA
Tutti i prezzi per le funzioni Premium sono indicati in Franchi Svizzeri (CHF) e includono l'IVA svizzera legale dell'8,1% in conformità con l'Ordinanza sull'indicazione dei prezzi (OIP).
4.2 Pagamenti
- App Store / Google Play: Soggetti ai termini delle rispettive piattaforme.
- TWINT (Payrexx AG): L'Utente deve fornire il proprio Pseudo SFF per l'attivazione manuale. L'Operatore non è responsabile per ritardi causati dall'inserimento di uno Pseudo errato.
4.3 Nessun rimborso
In conformità con il diritto svizzero, il diritto di recesso non si applica ai contenuti digitali una volta che l'esecuzione è iniziata con il preventivo consenso espresso dell'Utente. Tutte le vendite sono definitive, salvo in caso di comprovato inadempimento tecnico da parte dell'Operatore. I diritti legali di recesso o rimborso ai sensi della legge svizzera sulla protezione dei consumatori rimangono impregiudicati in caso di mancata prestazione del servizio.
5.1 Limite generale
L'Operatore è responsabile solo per i danni causati da dolo o colpa grave. La responsabilità per colpa lieve o media è esclusa nella misura massima consentita dall'Art. 100 cpv. 1 del Codice delle obbligazioni svizzero.
5.2 Ausiliari
La responsabilità per gli ausiliari (Art. 101 CO), come i fornitori di hosting di terze parti o i contributori di dati, è interamente esclusa.
5.3 Provenienza dei dati e danni indiretti
La responsabilità per danni indiretti, perdita di profitti, perdita di dati o danni derivanti da decisioni di guida/infrazioni stradali è esplicitamente esclusa.
6.1 Informativa sulla privacy
Il trattamento dei dati personali è regolato dall'Informativa sulla privacy di SFF.
6.2 Divulgazione dell'esportazione dei dati
L'Utente riconosce e acconsente che i dati personali (ad es. ID Google, log di pagamento) possano essere trattati su server situati nell'Unione Europea (UE) o negli Stati Uniti (USA), a condizione che siano in atto salvaguardie adeguate (come le clausole contrattuali standard) per soddisfare i requisiti della LPD.
Il codice sorgente dell'App, il design e il logo "Swiss Fuel Finder" sono di proprietà esclusiva di WTRH. Qualsiasi riproduzione non autorizzata o ingegneria inversa costituisce una violazione della Legge federale sul diritto d'autore e sui diritti affini (LDA).
L'Operatore si riserva il diritto di modificare le presenti CGC in qualsiasi momento. Gli Utenti saranno informati di modifiche significative tramite una notifica in-app. L'uso continuato dopo la notifica costituisce accettazione dei termini revisionati.
9.1 Legge applicabile
Le presenti CGC e tutte le controversie da esse derivanti sono soggette esclusivamente al Diritto sostanziale svizzero, con esclusione della Convenzione delle Nazioni Unite sui contratti di compravendita internazionale di merci (CISG).
9.2 Foro competente esclusivo
Il foro competente esclusivo per tutti i procedimenti legali è Losanna (Vaud), Svizzera. Per i consumatori, restano riservati i fori prescritti dalla legge.
